ACCEPTANCE OF TERMS OF USE

Welcome to BuzzAroundBooks.com! BlueBuzz Marketing Inc. provides its service to you, in the form of BuzzAroundBooks.com ("BAB"), subject to the following Terms of Use ("TOU"), which maybe updated by us from time to time without notice to you. You can review the most current version of TOU at any time at www.buzzaroundbooks.com/termsofuse. Furthermore, when using BuzzAroundBooks.com, you shall be subject to any posted guidelines or rules applicable to such services and contests which may be posted from time to time. All such rules and guidelines are incorporated by reference into the TOU. As a user and/or member of BuzzAroundBooks.com, you are subject to all the rules contained in this document and should therefore read this membership agreement carefully, since it may affect your rights. Usage of our site and membership will not be granted unless you agree to these terms of use. Acceptance of this Agreement constitutes acceptance of the current terms of use. As a user or member of BAB, you agree that you are at least 18 years of age or older, or have permission to use this site from your parent(s) or legal guardian(s). MEMBERSHIP

Your usage and membership with BAB is solely for your personal use. Any use of BAB's site by a third party or by you as the agent of a third party shall be deemed a violation of this Agreement. Upon violation, BAB may in its sole discretion, without notice, terminate that Member's access to BAB. Each Member is responsible for the use of his or her account. You may not authorize others to use your membership, and You may not assign or otherwise transfer your account to any other person or entity.

OBLIGATIONS

As BAB seeks to strengthen ties within its community of Members, violation of the following rules are unacceptable and will result in termination of your membership with BAB without notice.
You may not use BAB's site for unlawful purposes.
You are solely responsible for the content of information you post on BAB's site or transmit to other members of BAB.
You are solely responsible for your communications and interactions with other members of BAB.
You may not engage in fraudulent activity of any kind, including but not limited to forging postings so that they appear to originate from another member's account.
You may not impersonate any individual, including but not limited to, BAB staff or its members.
You may use only one membership account under your identity.
You will not use BAB in any manner that is defamatory, libelous, slanderous, threatening, harassing, abusive, vulgar, racist, hateful or otherwise objectionable.
You may not post any false or inaccurate information.
You may not post duplicate information to more than two (2) areas of the site.
You may not delete or change material posted by any other person.
You may not transmit, send, place or post unsolicited e-mail, promotional materials, telephone calls, mailings, chain letters and so forth to other members or anyone else whom you have found through the site, except in those areas that are designated for such purpose. This specifically excludes promotion of other web-sites, including but not limited to job-boards, and/or to commercial products and services.
You may not violate or attempt to violate the security or integrity of BAB's site or to interfere or attempt to interfere with the proper operation of the site or with any activity being conducted on the site. You may not decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of BAB's site. Any violation of the security or integrity of BAB's site will result in prosecution under provincial/state and federal laws.
PRIVACY POLICY
BAB gives its members great discretion over the dissemination of their individual information. We use the information we collect from members for the purposes of improving site experience (e.g., customization of content); contacting you for suitable employment opportunities (e.g., through the Career Center); facilitating community experience (e.g., allowing members to connect based upon common interests); and soliciting partners and sponsors (by calculating aggregated membership statistics).
Members can exercise the option of limiting the scope of individual information that is available to other members. BAB does not reveal a member's individual information to outside parties.
BAB may automatically receive and record information on our server logs from your browser, including your IP address and cookie information. For functional purposes, BAB may set and access cookies on your computer.
In the event that BAB or substantially all of its assets are acquired, member information will be one of the transferred assets.
You may not use BAB's site in any manner that may violate the privacy, publicity, or other personal rights of others, including but not limited to the posting of files (e.g., words, pictures, computer programs or other works of authorship), for which you do not have permission of the author to post and/or disseminate.

BAB is in compliance with the Children's Online Privacy Protection Act (COPPA) of 1998, which requires that BAB acquire parental or guardian consent prior to collecting, using and disclosing personally identifiable information about children under the age of thirteen. EDITORIAL CONTROL

BAB expressly reserves the right to delete messages, postings, files, or other material posted by members, in whole or in part, as they see fit.

E-MAIL

Acceptance of this Agreement authorizes BAB to send you a reasonable amount of e-mail, including but not limited to, marketing promotions, special events and general information regarding BAB. You can at any time choose not to receive general announcements via e-mail from BAB by adjusting your personal preferences.
BAB reserves the right to contact you with information on positions available to you through the Careers area that fit your specific qualifications. You can at any time choose not to receive job-related announcements via e-mail from BAB by logging into the Job Alerts section: No information will be forwarded to any company without your express permission.
BAB encourages all members to recruit/refer as many personal contacts as they would like for the purposes of expanding BAB's community. If you choose to enter BAB's member referral contests, you must comply with the stated rules. BAB does not authorize or encourage any member to send out mass e-mails (i.e., spam). Any member found to be engaging in such behavior will be subject to revocation of membership and prosecution under local, state, and federal laws.
By contacting BAB you authorize BAB to use all or part of that communication, including your name, in promotional advertisements without your express permission. All messages from members to BAB may be used as testimonials with regard to members' experience using the site without members' permission. All testimonials become property of BAB.


ARCHIVES

BAB will archive postings for the purpose of providing useful or important information to its members on an ongoing basis. Such archives will also be used to minimize system downtime in the event of a malfunction. By posting on BAB, you are giving us permission to copy and/or store your postings for these purposes.
BAB will also archive member-to-member e-mail for the purposes of protecting our members from defamatory, libelous, slanderous, threatening, harassing, abusive, vulgar, racist, hateful, or otherwise objectionable behavior. The privacy of member-to-member e-mail will be strictly guarded; however, if deemed necessary by BAB, we may access necessary archived e-mails without notification or permission from the member or members involved.
E-mails may be forwarded to the proper authorities for the purpose of assisting in prosecution of the party or parties involved in any prohibited behavior including, but not limited to, the above stated behavior.


INTELLECTUAL PROPERTY POLICY

The content included on BuzzAroundBooks.com, such as text, graphics, logos, artwork, characters, photographs, button icons, images and software (collectively referred to as "Material") are protected by Canadian and international copyright laws. All Material on BuzzAroundBooks.com is the property of BlueBuzz Marketing Inc. and BAB. The compilation (meaning collection, arrangement and assembly) of all content on this site is the exclusive property of BlueBuzz Marketing Inc. and BAB and is protected by Canadian and international copyright laws.
Reproduction, distribution, transmission, republication, display or performance of the content on BuzzAroundBooks.com for personal or commercial use is strictly prohibited without the express written consent from BlueBuzz Marketing Inc. or BAB. All copies that you make of the Material for permitted use must bear any copyright, trademark, service mark, patent or other intellectual property right in the Material or the products, services, processes or technology described in our web site. BlueBuzz Marketing Inc. and BAB retains all such rights.
The copying or adaptation of the code that BAB uses to create and to generate its pages is strictly prohibited. It is also protected by BAB's copyright. Violators will be prosecuted to the fullest extent of local, provincial/state, and federal law.
BAB owns the trademarks and service marks for BAB and BAB name and logo and all related products and service names, design marks and slogans. All other trademarks and service marks on this web site are the property of their respective owners. You cannot use any trademarks or service marks used on this web site, including BAB's name, without our consent or the consent of their respective owners.
The Canadian Intellectual Property Office’s A Guide To Copyrights states that “The Copyright Act provides that any “fair dealing” with a work for purposes of private study or research, or for criticism, review or news reporting is not infringement.  However, in the case of criticism, review, or news reporting, the user is required to give the source and the author’s, performer’s, sound recording maker’s or broadcaster’s name, if known” (6).  All BuzzAroundBooks.com members and users are expected to follow The Copyright Act’s guidelines.


PROPRIETARY RIGHT


BAB owns and retains other proprietary rights in its service. The service contains the copyrighted material, trademarks and other proprietary information of BAB and its licensors. Members may also post copyrighted information on the site, under the assumption that they have obtained the required legal rights to do so. Unless the information You are privy to is in the public domain or is that to which You have been given permission, You will not copy, modify, publish, transmit, distribute, or sell such proprietary information.
By posting information, content or photographs on the site, You automatically grant, and You represent that You have the right to grant, to BAB an irrevocable, non-exclusive, fully-paid, worldwide license to use, copy, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content and to grant and authorize sublicenses to that material that is posted.
You may not use BAB's site in any manner that may infringe upon any copyright, trademark, service mark, patent, trade secret or other intellectual property right of any individual or entity. You may not post or transmit any information without all applicable copyright, trademark, service mark, patent or other proprietary indicia and notices.


GENERAL DISCLAIMER
Any and all advice given by employees, moderators or members of BAB is merely a suggestion as to how a particular situation may or may not be handled. Any and all advice is given as a personal opinion not a professional opinion and should not be construed as such. The advice given serves as one point of view; individuals are encouraged to use their own best judgment regarding personal matters. Any and all advice implemented is done at one's own risk.


DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY


BAB provides its services on an as-is basis, without warranty of any kind, express or implied, including but not limited to any warranty for information, services or products provided through or in connection to BAB's site. BAB specifically disclaims any implied warranties of merchantability, fitness for a particular purpose or noninfringement.
BAB is not the publisher or author of any works posted by its Members. BAB is not responsible for the content of their postings and further disclaims all copyright in such works and all responsibility for them.
BAB acknowledges that its Members will be posting information on BAB's site and hereby disclaims any responsibility for the use or misuse of such information by a Member that violates any law or the personal privacy of any other Member.
BuzzAroundBooks.com DOES NOT accept any liability or responsibility for any loss or damage arising from transactions done from the use of its site, which may include, but is not limited to the buying, selling or trading of books through this site.  BAB users who choose to engage in such activities are solely responsible and are doing so at their own risk.
Furthermore, BuzzAroundBooks.com currently has no in-person meetings and choosing to meet with your fellow members should only be done at your own discretion and risk.  BAB accepts no liability or responsibility for the well being of individuals who choose to engage in such activities (i.e. meeting another member in-person).  

BAB cannot promise, and will not be deemed to promise that its hardware or software will function flawlessly. BAB fully intends to keep its system functional at all times. However, in the event that, due to circumstances beyond BAB's control, BAB's services malfunction or become unavailable to all or some members, BAB will not be liable for any direct, consequential or incidental damages, whether foreseeable or not, which may result from such unavailability or malfunction, except that BAB may, in its sole discretion, choose to credit members' accounts for such interruptions of service.
As a convenience to our members, not as an endorsement, BAB provides links to third party web sites and resources that are beyond our control. We make no representations or warranties as to the quality, suitability, functionality, legality, content or accuracy of the materials on those sites. Further, BAB holds no responsibility for the privacy practices of such web sites. You hereby waive any claim you may have against BAB with respect to such sites. If You download any software or otherwise executable files from BAB or a link provided by BAB, we assume no liability or responsibility for any direct, consequential or incidental damages caused by such software or files.
As a member who participates in the Career Center and any associated employment services, you understand that the BAB is acting as an agent for these services and does not guarantee that you will obtain employment. You further understand that BAB makes no guarantee as to the quality of a position accepted through the Career Center and you agree to release BAB from all liability thereof.
By permitting classified and personal advertising, BAB makes no warranties or representations of any kind as to the accuracy of the content or suitability of the subject matter of any such advertisement. BAB specifically disclaims liability for direct, consequential or incidental damages arising from such advertisements. By posting a personal or classified advertisement on BAB, you are promising that the content of your advertisement is true, and that You will indemnify BAB against any claims which may arise from Member advertisements. By responding to a classified or personal advertisement on BAB, You waive any claims against BAB for damages arising from such response or reliance upon statements in such classified or advertisement.
BAB assumes no responsibility or legal liability for any loss, injury, or problems you may suffer as a result of any contact with anyone you meet through BAB. Any and all exchange of personal information, including, but not limited to, addresses and telephone numbers with other members, by e-mail, at a BAB-sponsored event or otherwise is completely voluntary on the part of the members. Any exchange of personal information by members is based on the sole discretion and risk of the members.

INDEMNIFICATION

You agree, at the request of BAB, to defend, indemnify and to hold harmless BAB, its officers, directors and employees from any claims arising from your use of BAB, including, but not limited to, claims of copyright infringement, patent infringement, misappropriation of trade secrets, libel, slander, trade libel, defamation, harassment, invasion of privacy or fraud. You further agree to indemnify BAB against any claim or claims brought as a result of content of information you post or transmit to other of BAB's members.


JURISDICTION

This Agreement is to be construed under and governed by the laws of the Province of Ontario, and State of New York. Ontario and New York courts shall have jurisdiction over any claim or controversy arising under this Agreement. Any sort of illegal activity under the laws of the Province of Ontario or Canada or the State of New York or the United States is prohibited under this Agreement. Please be aware that the law as to jurisdiction over online activities is unsettled, and you may be found liable for violation of laws beyond Ontario and New York, or outside your particular state of residence, or other states, counties, or federal districts with which you have direct contact. BAB can provide no assurances that Members will, by their conduct, escape or incur liability in any jurisdictions.

TERMINATION
BAB reserves the right to cancel this membership agreement without notice and at the sole discretion of BAB.
Upon resignation, termination or revocation of membership, all personal information will be expunged from BAB's database within a reasonable amount of time thereafter, with the exception of necessary records of business transactions.
